Welcome to Ephemee. These Terms and Conditions ("Terms") govern your use of our platform and services. By creating an account or using Ephemee, you agree to comply with these Terms. If you do not agree, please do not use our platform.

Eligibility

You must be at least 13 years old to use Ephemee. If you are under 18, you confirm that you have obtained parental or guardian consent. By using our platform, you represent that you have the legal capacity to agree to these Terms.

User Responsibilities

You are responsible for your account credentials and all activity under your account. You agree to provide accurate and current information when creating your profile and to update it as needed. You must not use Ephemee for any unlawful purpose.

Prohibited Content and Conduct

  • Posting illegal, harmful, defamatory, or abusive content.
  • Engaging in harassment, spam, or fraudulent activity.
  • Attempting to disrupt the functionality of the platform or access unauthorized data.
  • Posting or promoting NSFW, sexually explicit, or adult content. Ephemee is a family-friendly platform and does not allow adult material.

Payments, Fees, and Payouts

Ephemee allows creators to receive monetary tips from fans. By using this feature, you agree to the following terms:

  • Platform Fee: Ephemee deducts a flat 5% platform fee from every transaction to cover the costs of running the service.
  • Payment Processing Fees: All payments are processed via Stripe. As a creator, you are the merchant of record and are responsible for Stripe's standard processing fees (typically 2.9% + 30¢ per transaction, though this varies by region). These fees are deducted automatically from the gross amount before payout.
  • Currency Conversion: Tips are collected in USD. If your connected bank account is in a different currency, Stripe will automatically convert funds at their daily exchange rate, which may include a small conversion fee.
  • Direct Payments: When a fan tips a creator, the transaction is a direct payment from the fan to the creator. Ephemee facilitates this transaction but is not a party to the payment itself.

To receive payouts, creators must connect a valid Stripe account. You are responsible for providing accurate tax and banking information to Stripe. Ephemee is not responsible for payouts lost due to incorrect information.

Intellectual Property

You retain ownership of content you share on Ephemee. By posting, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content within the platform. You confirm you have the rights to all content you upload.

Termination

We may suspend or terminate accounts that violate these Terms, misuse the platform, or for other reasons at our discretion. You may close your account at any time through your account settings.

Limitation of Liability

Ephemee is provided on an "as is" basis. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, Ephemee shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the platform.

Changes to These Terms

We may revise these Terms from time to time. Significant changes will be communicated to users, and continued use of Ephemee after changes are posted constitutes acceptance of the updated Terms.
